Thank you for your interest in participating in Crafted For Action, LLC Events. Before you proceed to purchase tickets, we strongly recommend that you read the following event ticket terms and conditions:

• In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you - the person who will buy the tickets to Crafted For Action Craft Beer Conference. On the other hand, ‘our’, ‘us’, ‘we’, ‘issuer’, ‘provider’ and similar terms will indicate the organizers of this EVENT - CRAFTED FOR ACTION, LLC.

• By opting to purchase, allocate or possess tickets to this EVENT, you automatically agree to our terms of use. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not purchase tickets or try to enter the EVENT premises.

• Please note that CRAFTED FOR ACTION, LLC. reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions - without any prior notifications to you. Such changes will be duly reflected on the website of the organizer (www.craftedforaction.com). These changes will relate back to the date of purchase of EVENT tickets.

• The prices of EVENT tickets is non-negotiable.

• The ticket you purchase represents a revocable license for you to access the EVENT on specified dates, when EVENT is scheduled to be hosted. The license includes the revocable right to attending the EVENT. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at any venue.

• The bearer has to assume full responsibility of the EVENT tickets, once he/she/they receives it. CRAFTED FOR ACTION, LLC. has no liabilities - financial, legal, or otherwise - in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.

• Kindly note that CRAFTED FOR ACTION, LLC.  is the sole authorized source for purchasing EVENT tickets. If you obtain your ticket(s) from any other unauthorized source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. The issuer has the right to dishonor such stolen/counterfeit tickets and declare them as void.

• The EVENT tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).

• Please note that EVENT tickets cannot be redeemed against cash, credits, or any other benefits.

• CRAFTED FOR ACTION, LLC. has the right to investigate if there has been any violation of the EVENT ticketing terms and conditions. In case of any conflicts, the decision of CRAFTED FOR ACTION, LLC. will be deemed final (i.e., the issuer will remain the final arbiter in cases of disputes).

• The event service will be deemed to have been delivered in its entirety as soon as EVENT starts on specified date. From that point on, no refund requests will be entertained.

• If EVENT is cancelled in its entirety due to any unforeseen circumstances, CRAFTED FOR ACTION, LLC. has the sole and absolute right to:

i) reschedule the event, or

ii) issue a partial/full refund, or

iii) not issue any refunds.

Please note that the decision of the issuer in such cases will be deemed final and binding.

• If EVENT is cancelled due to any factors or causes not in the control of the issuer, the latter will offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, delays in production, and the like. Once again, the decision of CRAFTED FOR ACTION, LLC. will be considered final.

• If EVENT has to be rescheduled to other dates, you will not be eligible for any refunds. In case the event is fully canceled, the refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.

• All ticket sales are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations.

• EVENT is a ‘rain or shine’ event. By purchasing the event tickets, you automatically confirm that you/the attendee(s) are of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending EVENT is 21.

• If it is proven beyond doubt at the venue that an attendee is below the ‘minimum age’, he/she/they will not be granted entry to EVENT. No refunds, full or partial, will be issued either.

• At the time of entering the event venue, you are required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.

• By purchasing EVENT tickets and presenting the same at the venue, you give your consent to CRAFTED FOR ACTION, LLC. to collect certain information about yourself (name, picture, date of birth, gender, address, etc.) for verification and storage.

• You hereby agree to forego all types of surcharge claims - full or in part - and all claims & entitlements related to it.

• CRAFTED FOR ACTION, LLC. does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

• EVENT and CRAFTED FOR ACTION, LLC. follow a common ‘zero-tolerance policy’ towards unauthorized drug usage or carrying at the venue, AND towards any type of behavior/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at EVENT and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.

• Please note that you purchase EVENT tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.

• In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final. In case a dispute cannot be resolved, the help of an independent third-party arbiter will be sought.

The objective of this policy is to elevate expectations against sexual harassment so that you and everyone we work alongside and do business with at Crafted For Action knows exactly where the organization stands, what to do if it happens, and always feels supported. We want you to know what sexual harassment is, how to recognize it, how to report it, how reports will be handled, what your rights are, and that we genuinely care about you and want to protect you. ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT

By purchasing tickets to EVENT, you are entering into this Waiver and Release of Liability in consideration of, and for the benefit for, participation in the events offered. You, the Participant, hereby acknowledge, represent, warrant and agree as follows, with the knowledge that Crafted for Action, LLC. will

rely on the warranties and obligations contained herein:

 

Voluntary Participation. Participant understands and confirms that participation in EVENT is fully voluntary. Participant hereby warrants that he or she or they is/are in good health and suffers from no physical or mental condition that would create an unreasonable and/or foreseeable risk of harm to himself or herself, or to any other participant of the EVENT.

 

Comprehension and Assumption of Risk . Participant understands and acknowledges that there are potential risks involved related to participation in the EVENT. Participant hereby assumes all risks, known and unknown, foreseeable and unforeseeable, in any way connected with Participant’s participation in the EVENT. Participant accepts full responsibility for any liability, injury, loss, damage or death in any way connected with their participation in the EVENT. Participant acknowledges that participation in the EVENT is at Participant’s sole risk.

 

Participant assumes the risks associated with traveling to and from location(s) to be

visited during the EVENT. Participant assumes the risk of any and all dangers presented on and in the street, sidewalk, or other areas, including but not limited to any and all traffic, cobblestone streets, and other pedestrian hazards.

 

Consumption of Alcohol. EVENT is for Participants twenty-one (21) years of age and older. Alcohol consumption shall be at Participant’s own discretion, risk and liability. Participant will be required to produce government-issued photo identification prior to the commencement of the EVENT Events if he/she/they wishes to partake in any alcohol during the Events. Crafted for Action, LLC reserves the right to excuse any Participant from the EVENT if said Participant becomes inebriated and misbehaves or has the potential to cause harm to him or herself or any other person or persons. If a Participant is excused from the EVENT pursuant to this paragraph, it shall be without any sort of reimbursement from or liability of Crafted for Action, LLC. All Participants hereby assume all risk involved with the consumption of alcohol and unconditionally hold Crafted for Action, LLC harmless.

 

Release of Claims. Participant hereby releases Crafted for Action, LLC from any and all liability or claims which may arise from participation in the EVENT. This paragraph shall be inclusive of, but not limited to, any injury or death resulting from exposure to food or beverage allergies, food borne illnesses, theft of or damage to Participant, Participant’s property, transportation or commute, as well as any exposure to adverse weather conditions, or choking. Participant, on behalf of Participant and Participant’s successors, designees, agents or assigns, hereby forever and unconditionally releases Crafted for Action, LLC, its owners, officers, employees, agents, successors in interest and insurers (hereinafter referred to as the “Released Entities”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses, including, without limitation, attorney’s fees, in any way arising out of, or resulting from, Participant’s participation in the EVENT. Participant further acknowledges that Crafted for Action, LLC is in no way liable for any injury to resulting from Participant’s own conduct or behavior.

 

Medical Expenses and Consent to Medical Treatment. Participant hereby accepts full financial responsibility for any personal medical expenses or treatment which may result from participation in the EVENT, and hereby releases Crafted for Action, LLC in full from any potential claim for such medical expenses. Further, Participant hereby authorizes Crafted for Action, LLC to provide Participant with medical treatment, whether resulting from an emergency or otherwise, and hereby releases Crafted for Action, LLC from any and all actions in tort for the provision of such medical attention. Nothing in this paragraph shall be construed to create an actual or implied duty upon Crafted for Action, LLC to provide or seek such medical treatment for Participant.

 

Indemnification. Participant agrees to pay any and all costs, fees, expenses and charges arising from any act or conduct of Participant that results in damage or injury to any person, including, but not limited to, any third party participant of the EVENT or employee of Crafted for Action, LLC. Participant further agrees to indemnify and hold Crafted for Action, LLC harmless from and against any such act or conduct which results in damages of any kind.

 

Promotional Release . Participant hereby grants Crafted for Action, LLC a worldwide, royalty-free irrevocable license to use Participant’s photographic, video, or digital likeness for promotional, educational, and/or commercial purposes. This Paragraph shall, however, be limited to pictures, videos and descriptions of events which are captured in the course of the Events, or within a reasonable time thereof. Participant can opt out from providing permission for the Promotional Release discussed herein by providing notice, in writing, to Crafted for Action, LLC.

 

Participant acknowledges that he or she has carefully read this Agreement and submits to all of the foregoing provisions before attending EVENT. Further, Participant acknowledges that he or she enters into this Agreement under his or her own volition.

 

Participant acknowledges that he/she/they is/are giving up substantial rights by agreeing to the provisions of this Agreement and understands that this is a legal document. Purchasing tickets is acknowledgement that Participant has read this waiver, is giving up his/her/their right to sue or otherwise make claims against Crafted for Action, LLC as defined herein and limiting his/her/their recovery for any allowable claims.

 

COVID-19 POLICY

By reading this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending Crafted for Action, LLC activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at a Crafted for Action, LLC event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Crafted for Action, LLC employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at Crafted for Action, LLC activities or participation in Crafted for Action, LLC programming (“Claims”). On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Crafted for Action, LLC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Crafted for Action, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Crafted for Action, LLC event. I agree to abide by any and all local, state, and/or federal laws with regards to COVID-19, including but not limited to wearing a mask at all required and necessary times, such as, but not limited to, when walking from establishment to establishment.

 

By purchasing tickets, I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THESE TERMS, CONDITIONS AND POLICIES, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
